THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.183 OF 2016 ORDER:

This criminal Petition is filed by the petitioners - Accused Nos.1 to 10 under Section 438 Cr.P.C., seeking to grant anticipatory bail in Crime No.136 of 2015 on the file of Mudinepalli Police Station, Krishna District, registered for the offences punishable under Section 509 and 506 r/w. 34 IPC and 3 (1) (x) of the SC & ST (Prevention of Atrocities) Act. Heard and perused the material available on record. The de facto complainant belongs to SC community and the son of the petitioners 1 and 2 loved her and married her against the wishes of his parents. The other petitioners are the relatives of the petitioners 1 and 2. The allegation against the petitioners is that they abused the de facto complainant in the name of her caste in a quarrel with regard to property dispute.

Learned counsel for the petitioner submitted that the petitioners never committed the offences alleged against them and to grab the property of the petitioners 1 and 2, the present complaint was filed with false allegations. Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioners. However, the petitioners are directed to surrender before the Magistrate concerned and file applications for grant of bail and on filing of such application, the learned Magistrate is directed to consider the said application on the same day.
