THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7734 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.3 and 4 seeking bail in the event of their arrest in connection with Crime.No.58 of 2023 on the file of Nagaram Police Station, Suryapet District, registered for the offences under Sections 498-A and 306 r/w. 34 of IPC.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

According to the complaint of the deceased brother, the deceased married A-1, 17 years prior to the incident. However, on account of harassment and insulting by the husband/A-1 stating that she was a characterless woman and having affairs with other persons, she committed suicide by consuming poison. 4.

Learned counsel appearing for the petitioner would submit that though the petitioners are related, they have nothing to do with the differences between A-1 and his deceased wife. The 1st petitioner was married sister and living separately with her family.

Since there are no specific allegations about these petitioners in the complaint as to how they abetted suicide, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioners subject to the following conditions:

1) The petitioners/Accused No.3 and 4 are directed to surrender before the Station House Officer, Nagaram Police Station, Suryapet District on 28.08.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos.3 and 4 on bail, on their executing personal bond for a sum of Rs.20,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/Accused Nos.3 and 4 shall appear before the concerned Police as and when required for the purpose of investigation.

3) The petitioners/Accused Nos.3 and 4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
