THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37327 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of respondents 1 and 2 in not taking action on the complaint, dated 23.03.2016, as illegal and arbitrary.

Heard and perused the material available on record. The case of the petitioners is that the petitioners are in possession of the land to an extent of Ac. 3.09 guntas at Ketanpally Shivar, Mandamarri Mandal and that respondents 3 to 6 came to the land of the petitioners and disturbed their possession by removing the boundary stones and the respondents 3 to 6 came with tractors and levelled the land of the petitioners and when the petitioners questioned respondents 3 to 6, they threatened with dire consequences. Aggrieved by the same, the petitioners lodged a written complaint to the 2nd respondent on 23.03.2016. The main grievance of the petitioners is that even though the complaint is lodged on 23.03.2016, the 2nd respondent is not taking any action on the complaint, dated 23.03.2016, given by the petitioners.

Considering the grievance of the petitioners, the 2nd respondent is directed to register a case against respondents 3 to 6, if the complaint lodged by the petitioner, dated 23.03.2016, discloses any cognizable offence and investigate into the same and file a final report if any. If the petitioners are aggrieved by the action of the 2nd respondent, they are at liberty to approach the superior officer of 2nd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 2nd November, 2016 KL
