Heard learned counsel for the petitioner and learned Government Pleader for Revenue for respondents 1 and 2. 2.

According to the averments in the affidavit filed in support of writ petition, petitioner is a senior Citizen. He is having grievance against his children not providing maintenance to him and his wife and not providing protection of sale of his properties. Petitioner claims that he submitted application to the Revenue Divisional Officer-2nd respondent, but no action was taken. He has also filed appeal under Section 5 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 on 23.04.2019. But so far there is no progress in the appeal filed by him. On account of delay in considering his appeal, grave prejudice is caused to the petitioner. 3.

Learned Government Pleader, on instructions, submits that notice was issued on 26.09.2019 fixing 11.10.2019 as the date of hearing and within reasonable time, the proceedings would be concluded.

Having regard to the above submission, without expressing any opinion on merits, the Writ Petition is disposed of directing the 2nd respondent to consider the appeal filed by the petitioner, after affording due opportunity to both parties and pass orders on the interlocutory application or in appeal, as expeditiously as possible, taking due note of time of 90 days stipulated for disposal of appeal

- 3 - filed by the petitioner. Pending miscellaneous petitions, if any, shall stand closed.
