THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.17645 of 2012 ORDER:

Feeling aggrieved of the inaction of the respondents 1 to 5 in not bringing the fish tanks in an extent of Ac.2.50 cents in Sy.No.12/2 and in an extent of Ac.3.80 cents in R.Sy.No.75/A of Mulakalapalli village into the purview of Gram Panchayat at Mulakalapalli, this writ petition is filed to declare the said inaction as illegal, arbitrary and unjust and violative of principles of natural justice; and, to consequently direct the respondents to immediately bring the above fish tanks under the purview of the Gram Panchayat, Mulakalapalli. I have heard the submissions of the learned counsel for the writ petitioners and the learned Government Pleader for Panchayat Raj.

During the course of hearing, the learned counsel for the writ petitioners submitted that after the writ petition is filed in the year 2012, the subject fish tanks were leased out to the 2nd petitioner from 2013 onwards and that the 2nd petitioner is paying the lease amount to the Gram Panchayat and that in view of the said subsequent event, the object of filing of the writ petition is achieved and that, therefore, nothing survives for adjudication in this writ petition. Therefore, he prays to record his submission and close the writ petition. Recording the aforesaid submission, the Writ Petition is closed. There shall be no order as to costs.

Miscellaneous petitions, pending if any, in the writ petition shall stand closed.
