THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 5944 of 2022 ORDER:

This Criminal Petition is filed under Section 437 & 439 of the Code of Criminal Procedure,' 1973 (for short "Cr.P.C.") seeking to enlarge the petitioner/A5 on bail in connection with Crime No.395 of 2022, on the file of Pet Basheerabad Police Station, Cyberabad, registered for the offences punishable under Sections 147, 148, 447, 427, 324 read with 34 of Indian Penal Code.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that on 17.05.2022, a complaint was lodged stating that this accused along with others trespassed into the premises of complainant and assaulted a person by throwing chili powder on him. 4.

Learned Counsel for the petitioner submits that in fact all the other accused have already been released on bail.

Learned Assistant Public Prosecutor submits that this petitioner/accused No.5 engaged the other accused who subsequently assembled unlawfully and trespassed into the said land and assaulted the person.

The said injured person was treated as out-patient and already discharged from the hospital. Further, there are no other cases pending against this petitioner. In the said circumstances, this petitioner can be released on bail subject to the following conditions:

i. The petitioner/A5 is directed to be released on bail on his executing personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each, to the satisfaction of XXII Additional Metropolitan Magistrate, Medchal. ii. On such release, the petitioner/A5 shall appear before the concerned Station House Officer on every Monday between 10.30 a.m. to 1.00 p.m. for a period of eight weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation.

iii. The petitioner/A5 shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C.

Accordingly, the criminal petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
