HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.7 OF 2017 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner-A.1 in Cr.No.367 of 2016 of Station House Officer, Pedakakani, Guntur District, registered for the alleged offences punishable under Sections 408, 420, 468 and 473 read with 34 I.P.C. apprehending his arrest in connection with the above crime by the police during investigation.

Petitioner herein is A.1. He prayed for pre-arrest bail or alternatively to direct the police concerned to follow the guidelines provided under Section 41-A of Cr.P.C. though scope of Section 438 Cr.P.C. is limited, on various grounds.

But, during hearing, the learned counsel for the petitioner requested this court to issue a direction to the police to follow the guidelines provided under Section 41-A of Cr.P.C. without touching the merits in the above petition and guidelines of ARNESH KUMAR V. STATE OF BIHAR (1).

In view of the request made by the learned counsel for the petitioner-A.1, the Investigating Agency i.e., Pedakakani Police Station, Guntur District, is directed to follow the procedure provided under Section 41-A of Cr.P.C. and guidelines in ARNESH KUMAR V. STATE OF BIHAR (1st cited) while negating the relief of pre-arrest bail.

With the above direction, this Criminal Petition is dismissed. 1 2014(2) ALT (Crl.) 457 (SC)
