THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.7665 OF 2021 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C), is filed by the petitioner/A.1 seeking to direct the learned V Additional Metropolitan Magistrate, at Cyberabad, L.B.Nagar, to dispose of the Crl.M.P.No.420 of 2021 in C.C.No.3174 of 2021 pending on its file, expeditiously. 2.

Heard the learned counsel for petitioner/A.1, learned Assistant Public Prosecutor appearing for respondent No.1/State and perused the record.

The learned counsel for the petitioner/A.1 would submit that the petitioner/A.1 in order to join his employment as Network Automation Engineer, in NTT America, Florida City, U.S.A, has filed Crl.M.P.No.420 of 2021 in C.C.No.3174 of 2021 before the Court below on 29.07.2021, seeking release of his passport bearing No.L4712247 and to set aside the Look Out Circular, but till date, the it has not been disposed of. The petitioner/A.1 has to join duty in America by 07.10.2021, failing which he would lose his job and ultimately prayed to allow the Criminal Petition as prayed for.

As seen from the material placed on record, the petitioner/A.1 has filed Crl.M.P.No.420 of 2021 in C.C.No.3174 of 2021 before the Court below on 29.07.2021, seeking release of his passport bearing No.L4712247 and to set aside the Look Out Circular. The said application has not yet been disposed of.

Though the petitioner/A.1 has raised several other contentions for release of his passport, it is not appropriate to go into the merits of the case and determine the lis. In the given circumstances of the case, this Court deems it appropriate to issue the following direction:

"The learned V Additional Metropolitan Magistrate, at Cyberabad, L.B.Nagar, is directed to dispose of Crl.M.P.No.420 of in C.C.No.3174 of 2021, on merits, as expeditiously as possible, preferably within one (1) week from today, in accordance with law."

With the above direction, this Criminal Petition is disposed of.

Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
