THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7742 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.2 in Crime.No.217 of 2023 on the file of Mangalhat Police Station, Hyderabad, registered for the offence under Section 8(c) r/w. 20 (b) (ii) (B)of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The case of the Mangalhat Police is that on 27.07.2023, the petitioner was arrayed as A-2 and the petitioner and another was found in possession of 2.5 kgs. of ganja. The said contraband was seized and petitioner and another were sent to judicial remand.

Learned counsel appearing for the petitioner would submit that the quantity of contraband seized is less than the commercial quantity and earlier one case was registered under NDPS Act.

On instructions, learned Additional Public Prosecutor would submit that there are several cases pending against this petitioner for the offence under Section 8(c) of A.P. Prohibition Act in Mangalhat Police Sattion and also in Dhoolpet Police Station.

Keeping in view that the contraband seized is less than the commercial quantity, this Court deems it appropriate to grant the relief of regular bail to the petitioner subject to following conditions:

i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of XVI Additional Chief Metropolitan Magistrate, at Hyderabad.

ii) The petitioner/Accused No.2 after release shall appear before the concerned Station House Officer at 10:00 a.m. everyday for a period of four

weeks and thereafter, as and when required for the purpose of investigation.

iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
