THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.7758 of 2016 ORDER:

In the light of the order dated 29.01.2016 passed by this Court in W.P.No.1802 of 2016 upon concession, it is not open to the mining authorities to refuse to issue dispatch permits or raise an objection to the use of machinery only by the petitioner in this case for transporting the stock of excavated mineral in accordance with the order dated 07.09.2015 passed by the National Green Tribunal, Southern Zone, Chennai.

The writ petition is accordingly allowed. The mining authorities shall not interfere with the activities of the petitioner in removing and transporting the excavated Silica sand in accordance with the order dated 07.09.2015 passed by the National Green Tribunal, Southern Zone, Chennai, and shall take necessary steps in aid thereof by issuing dispatch permits in accordance with the due procedure. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 10th March, 2016 IBL
