THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.5762 OF 2018 ORDER:

This criminal petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') to recall of nonbailable warrant dated 04.06.2018 issued against the petitioner/A.1 in C.C.No.172 of 2012 pending before the III Additional Chief Metropolitan Magistrate, Gajuwaka, on various grounds.

During hearing, learned counsel for the petitioner requested this court to permit the petitioner to appear before the III Additional Chief Metropolitan Magistrate, Gajuwaka, and to file an application under Section 70(2) Cr.P.C.

In view of the request made by the counsel for the petitioner, without touching the merits of the case, the petitioner is permitted to appear before the III Additional Chief Metropolitan Magistrate, Gajuwaka, and to file an application under Section 70(2) Cr.P.C. in C.C.No.172 of 2012, after due service of notice on the Public Prosecutor. On filing such application, the learned Magistrate is directed to dispose of the same on the same day, in accordance with law.

With the above direction, the criminal petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
