08.03.2022 LK, J I.A.No.1 of 2022 This petition is filed seeking to relax condition No.(ii) vide order dated 18.10.2021 in Crl.P.No.7647 of 2021.
Learned counsel for the petitioner Mr. G.
Madhusudhan Reddy, submits that this Court, by order dated 18.10.2021, while granting bail has directed the petitioner/accused to appear before the Station House Officer, Mallial Police Station, Jagtial District, on every Sunday between 10.00 am and 12.00 noon till filing of charge sheet. Learned counsel submits that the petitioner is fulfilling the said condition. However, he submits that the petitioner is a student and pursuing his studies in Chennai and it has become very difficult for him to travel on every Sunday. He submits that the petitioner is ready to cooperate with the investigation and whenever his presence is required, he shall appear before the police and hence, the said condition may be modified. Learned Assistant Public Prosecutor does not dispute the fact that the petitioner is complying with the said condition.

OFFICE NOTE Taking into consideration the submission of the learned counsel for the petitioner that the petitioner is pursuing his education in Chennai, this Court deems it appropriate to relax the said condition. However, whenever the presence of the petitioner is required for the purpose of investigation, the police concerned shall issue advance notice to the petitioner for his appearance, and on receipt of such notice, he shall appear before the police without fail.
Accordingly, I.A., is allowed.
