Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a writ order or direction more particularly in the nature of writ of mandamus declaring the illegal action of the respondents not accepting tender schedules or not entering into agreement with the Petitioner in spite of fulfilling all the conditions in terms of G.O.Ms.No.14 dt.31-01-2015 of Irrigation department and entering into agreement with the 4th respondent herein through agreement No.24/2015-2016 dt.
23-06-2015 is not successful bidder then the Petitioner is illegal, arbitrary and violation of articles 14 and 19 (1), (g), of the Constitution of India and consequently direct the respondents to set aside the agreement No.24/2015-16 dt.23-06-2015 entered with the 4th respondent and accept the tender Schedule of the petitioner by entering into the agreement and allowing to execute the works in case of becoming successful bidder in tender notice No.IFB SE/TW/WGL/NTT/253/2014-15, Dt.06-04-2015 for the work of construction of administrative building for camping ground at Dar head quarters at Khammam (V & Dist.)
The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and the order of the High Court dated: 09.07.2015 and upon hearing the arguments of Sri Kuna Reddy Anji Reddy, Advocate for the Petitioner and GP for Social Welfare (TG) for Respondent Nos.1 to 3, the Court made the following ORDER:
At the request of the learned G.P., post the W.P after Dasara Vacation, 2015. Meanwhile, the interim order granted on 09.07.2015 shall continue.
