THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.21819 of 2019 ORDER:

The case of the petitioner is that she succeeded the old residential house bearing No.6-12/1, situated at Medipally Village from her father and since last 20 years she is residing in the said house. While so, the 3rd respondent obtained permission from the 2nd respondent for making construction in the said house number by submitting false documents Therefore, the petitioner made a representation before the 2nd respondent requesting to cancel the permission granted to the 3rd respondent. Since no action is taken by the 2nd respondent on the application filed by the petitioner, the present writ petition is filed.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondents.

3. Learned Standing Counsel for the 2nd respondent submitted that the petitioner has to file an appeal before the Appellate Authority i.e. the District Collector, under Section 121 of the Telangana Panchayat Raj Act, 2018. The same could not be disputed by learned counsel for petitioner.

4. In view of the above submission, the writ petition is disposed of granting liberty to the petitioner to file an appeal under Section 121 of the Telangana Panchayat Raj Act, before the Appellate Authority. No order as to costs. Miscellaneous Petitions, if any pending, shall stand closed.
