THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY TR.CMP No.211 of 2015 ORDER:

This petition is filed under Section 24 of C.P.C to withdraw F.C.O.P.No.750 of 2014 from the file of the Family Court, Secunderabad and transfer the same to the Family Court, R.R. District at L.B. Nagar.

2. When the matter is taken up for hearing, the learned counsel for petitioner while seeking permission of this Court to withdraw the transfer C.M.P., submitted that the presence of the petitioner-wife may be dispensed with in FCOP No.750 of 2014 on the file of the Family Court, Secunderabad on each and every date of adjournment.

3. Permission as sought for is granted.

4. Accordingly, the Transfer Civil Miscellaneous Petition is dismissed as withdrawn. The Family Court, Secunderabad is hereby directed to dispense with the presence of the petitioner in FCOP No.750 of 2014 on each and every date of adjournment. However, the petitioner shall appear as and when the Court feels that her presence is so required. No costs. Miscellaneous petitions, if any pending, in this petition shall stand closed.
