Petitioner claims that though she belongs to a scheduled caste category, she married an upper caste person. However, her husband died at very young age leaving behind his daughter. On account of sudden demise of her husband, the family is put to dole drums and has become difficult to eke out the living. They do not have the house of their own. According to the petitioner, a house earlier allotted to the beneficiary is left idle and after the death of the said beneficiary, there is no other dependant in his family. Having noticed the availability of the house earlier assigned but kept vacant, an application is submitted by the petitioner to consider the claim. Alleging inaction on the said application, this writ petition is filed.

Having regard to the above, without expressing any opinion on merits of the claim, the Writ Petition is disposed of, directing the Revenue Divisional Officer, Eluru, West Godavari District (3rd respondent) to examine the claim of the petitioner vis-à-vis the policy of the Government for assignment of house site pattas/houses, and if the petitioner is otherwise eligible, her claim may be considered. On due examination of the claim, a decision be taken and communicated to the petitioner, by assigning due reasons in support of his decision, as expeditiously as possible, preferably within a period of two (2) months from the date of receipt of copy of this order. There shall be no order as to costs.
