THE HON'BLE SRI JUSTICE P. NAVEEN RAO CONTEMPT CASE No.1280 OF 2016 ORDER:

This Court by order dated 28.04.2014 disposed of W.P.No.13512 of 2014 directing respondents 1 and 2 to consider the representation of the petitioner dated 06.03.2014 and to pass orders thereon.

The claim of the petitioners in the Writ Petition was that they are the owners of land to an extent of 96 sq. yards and 39 sq. yards respectively in Survey No.129/A/A of Sathupally Revenue Village, Khammam District. Pursuant to the directions of this Court, the earlier Tahsildar, vide order dated 18.03.2008, ordered removal of construction made by the petitioners. Thereafter, on the directions of the Joint Collector, Khammam, on appeal by the petitioners, the subsequent Tahsildar, passed orders on 06.01.2014 in favour of the petitioners. Thus, there is discrepancy with regard to the ownership of the subject land as belonging to the Government or to the parties.

Having regard to the said discrepancy, the competent authority directed the Assistant Director, Survey and Land Records, Khammam, to resurvey the land in question and to submit report and the same was informed to the petitioner herein vide letter dated 24.08.2016 and petitioner was informed that as soon as the report is submitted, appropriate decision would be taken.

In view of the communication given to the petitioner in letter dated 24.08.2016, this Court is of the opinion that the directions of this Court are complied with. Therefore, no case is made out for initiation of proceedings under the Contempt of Courts Act, 1971. 5.

The Contempt Case is accordingly closed.
