VRS, J & NBY, J HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE N. BALAYOGI ORDER: (V. Ramasubramanian, J) Contending that he was not given the ACP Scale-II in the category of Senior Civil Judge and that his representations in this regard are also not disposed of, a retired District Judge has come up with the above writ petition.

2. Heard Mr. K. Ramesh Babu, learned counsel for the petitioner and Mr. Swaroop Oorilla, learned standing counsel for the Registry.

3. The petitioner was due to get ACP Scale-II in the year 2015. It was not given to him since the ACRs for a period of 5 years preceding the date of eligibility for ACP were not completed.

4. The petitioner also retired from service on 31-07-2016. Still he has not got ACP Scale-II. Hence, the present writ petition.

5. It is stated on instructions that the ACR for 2011, was not completed and that this was the reason for non-grant of ACP ScaleII.

6. But the petitioner has already retired from service. Therefore, it is better to dispose of his representations considering his case in the light of the fact that for no fault of the petitioner, the grant of ACP is delayed.

Therefore, the writ petition is disposed of directing the Registry to consider the representations of the petitioner dated 30-07-2015 and 20-03-2018 respectively and pass orders within a period of eight (8) weeks from the date of receipt of a copy of the order. The respondents shall take into account the fact that at this distance of time, the ACR for 2011 cannot stand in the way of the petitioner getting ACP Scale-II.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
