This Petition coming on for hearing,upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri RAMA MOHAN PALANKI ,Advocate foi the Petitioner and the Public Prosecutor on behalf of the Respondent No.1 and of Sri R. JANIKIRAM, Advocate for the I Respondent No.

HONOURABLE DR. JUSTICE CHILLAKUR SUMALATHA CRIMINAL PETITION No.5964 OF 2022 ORDER:

Heard, the submission oF learned counsel for the petitioners, learned Assistant Public Prosecutor as well as the learned counsel appearing for the respondent No.2. 2.

Seeking the Court to quash the proceedings that are pending against the petitioners who are arrayed as accused as 2 to 5 in CC No.12B of 2020 pending on the file of the Court of XXII Addl. Metropolitan Magistrate, Medchal, the present Criminal Petition is filed.

Though the learned counsel for the petitioners argued at length in respect of the merits of the case, however finally learned counsel states that no further orders in this criminal I I I I petition are required except to dispense with the presence of the petitioners before the Trial Court. The respondents does not raise a ny objection .

On the other hand, the 2nd respondent himself stated to dispense with the presence. Therefore, this Court considered the request of learned counsel for the petitioners.

Resultantly, the criminal petition is disposed of with the following direction:

i) The Court of XXII Addl. Metropolitan Magistrate Court at Medchal is directed not to insist personal appearance oF the petitioners Nos.1 to 4 who are arrayed as accused as 2 to 5 in CC No.12B of 2020 that is pending before the said Court during the course of proceedings, in case they are represented by an advocate.

ii) However, the petitioners Nos.1 to 4/Accused Nos.2 to 5 shall make their appearance before the trial Court in case a specific direction to that effect is issued. 6.

As a sequel thereto, miscellaneous petitions pending, if any, sha ll stand closed.
