HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION Nos.4899 and 4886 of 2015 COMMON ORDER :

These Criminal Petitions are filed by the one and the same Petitioner/Accused under Section 482 Cr.P.C seeking to quash the proceedings in C.C. No.204 of 2008 and C.C. No.196 of 2008 on the file of II Additional Chief Metropolitan Magistrate, Visakhapatnam which was numbered in pursuance of Crime No.169 of 2003 and 169 of 2003 respectively of II Town Police Station, Visakhapatnam registered for the offences punishable under Sections 468, 471, 419, 420, 120-B read with 34 I.P.C.

2) Heard the learned counsel for the petitioner as well as the 1st respondent State represented by the Public Prosecutor before admission and before ordering notice to the 2nd respondent-defactocomplainant and perused the material on record.

3) As the material falls short for this Court to admit the application under Section 482 Cr.P.C, this application is disposed of giving liberty to the petitioner to file an application, under Section 216 Cr.P.C if there are any grounds for alteration of charges or deletion of charges, for the consideration of trial Court on its own merits, since stated that charges already framed after hearing as contemplated under Section 240 Cr.P.C. Needless to say the trial Court shall give early disposal of the case by following Section 309 Cr.P.C in letter and spirit and if the petitioner file any application under Rule 37 of Criminal Rules of Practice, after hearing can permit one or few of the accused to represent the others during trial subject to condition of personal appearance as and when required.

4) With the above observations, these criminal petitions are
