THE HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 283 of 2017 Order:

This Writ Petition was filed challenging the action of the official respondents in interfering and trying to lay road by encroaching the petitioner's land of an extent of 9000 sq. yards, situated in Survey No.32 of Guttalabegumpet, Serilingampally Mandal, Ranga Reddy District, without considering the petitioner's representations dated 20.10.2016 and 22.12.2016.

The petitioner states that he along with two others entered into a Memorandum of Understanding on 24.12.1988 for development of the land of an extent of Ac.4-00, situated in Survey No.32 of Guttalabegumpet, Serilingampally Mandal, Ranga Reddy District. They already developed another extent of Ac.8-00 belonging to one M. Butchaiah and others who are relatives of one of the partners of the petitioner. They applied for regularization under LRS by paying part payment and the same was under consideration. There were several writ petitions and civil suits filed against the State as well as private individuals. The layout was existing, which was prepared in the year 1968, and the same was followed by the petitioner by converting the land of an extent of Ac.12-32 gts., situated in Survey No.32, into 219 plots.

In view of the influence exerted by some people, when the respondents are changing the layout, they submitted representations on 20.10.2016 and 22.12.2016 and when no action was taken, the present Writ Petition was filed stating that the land of an extent of 9000 sq. yards covered with blue sheets was being interfered with by the official respondents by damaging the sheets.

When the matter is taken up for consideration today, learned counsel for the petitioner submitted that the respondents are not interfering with their land, whereas learned counsel appearing for the respondents submits that the existing road was re-laid and there was no interference as alleged by the petitioner.

However, in order to set at rest the dispute, the Writ Petition is disposed of directing the respondents to consider the representations of the petitioner dated 20.10.2016 and 22.12.2016 and pass appropriate orders in accordance with law within a period of three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
