HON'BLE MRS. JUSTICE ANIS A.S.M.P.NOS.1377 & 1378 OF 2017 AND APPEAL SUIT No.2120 of 2002 COMMON JUDGMENT:

A.S.M.P.No.1378 of is filed by the petitioners/appellants to permit the petitioner No.2 to appear on behalf of petitioner No.3 under Special Power of Attorney dated 28-06-2017 executed by petitioner No.3 in favour of petitioner No.2. In view of the reasons mentioned in the affidavit filed in support of the petition, this A.S.M.P.No.1378 of 2017 is allowed.

A.S.M.P.No.1377 of is filed by the petitioners/appellants to record compromise and pass decree in terms of the memorandum of compromise. Petitioner No.2 who also represents petitioner No.3 under Special Power of Attorney, petitioner Nos.4 and 5 as well as respondent are present in the Court. Both counsel represented that the parties herein have entered into compromise as set out in the memorandum of compromise.

The contents of the memorandum of compromise are read over and explained to both parties. Both parties agreed voluntarily for the compromise as per the terms of memorandum of compromise. 03.

The appellants herein were defendants in the trial court. The respondent herein filed the suit in O.S.No.471 of 1990 on the file of the court of Prinicpal Senior Civil Judge, Guntur for

recovery possession of plaint schedule property and for damages for use and occupation of the suit schedule property. The said suit was decreed. Being aggrieved by the judgment and decree, the defendants filed the present appeal. 04.

Therefore, in view of the compromise entered into between both parties, ASMP No.1377 of 2017 is allowed and Appeal Suit is accordingly dismissed. Registry is directed to draft a decree in terms of memorandum of compromise. No order as to costs. Miscellaneous Petitions, if any, pending in this Appeal Suit shall stand closed.
