HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 4260 of 2017 Order:

This Writ Petition is filed challenging the action of the respondents 2 to 6 in not considering the representations of the petitioner dated 08.04.2016, 08.11.2016 and December 2016 after registration of FIR No.25 of 2016 dated 17.08.2016 by Narsingi Police, Cyberabad, under Section 506 IPC, and FIR No.18 of 2016, dated 18.02.2016, on the file of Moghalpura Police Station, Hyderabad, under Section 302 IPC and not including the names of the respondents 7 to 9 even after their involvement in the offence under Section 302 IPC and also the action of the respondents 10 and 11 in not furnishing post-mortem report as illegal and void.

It is stated by the learned counsel for the petitioner that initially FIR No.25 of 2016 was registered and, later on, after transfer of the case to the CCS, the Moghalpura police registered FIR No.18 of 2016 under Section 302 IPC and the case is under investigation. The petitioner states that in spite of submitting representations, the respondents 2 to 6 have not been taking the said representations into consideration. It is an admitted case that the crime is under investigation and the respondent No.5 is investigating the crime. In the process of investigation the petitioner submitted representations. It is for the Investigating Officers to take the said representations into consideration and take appropriate action in accordance with law. In view of the clear position of law, no direction can be issued to the respondents, more particularly to the respondents 5 and 6 to act in a particular manner and it is for the concerned Magistrate to look into the aspect of the investigation. It is

needless to observe that the Investigating Officer would follow due process of law during the course of investigation and would take into consideration the information furnished by the petitioner. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
