HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.16553 OF 2016 ORDER:

The writ petition is filed questioning the action of the respondents 2 and 3 in taking steps to auction the gold pledged by the petitioners.

Earlier this Court granted an interim order dated 22.09.2011 in W.P.No.26635 of 2011 on a condition of the petitioner depositing 1 1⁄4 of loan amount. Learned counsel for the petitioner fairly submits that the petitioner did not fulfil the conditions made in the said interim order. Considering the fact that the auction has already been concluded and the same was confirmed, no further orders can be passed in this writ petition. However, the petitioner may avail the alternative remedy of appeal or any other provisions available to him both with respect to the auction notice or with respect to the auction. With the above observations, the writ petition is disposed of. No order as to costs.

Consequently, Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
