This writ petition is filed for declaring the action of the fourth respondent in not investigating into Crime No.578 of 2019, dated 12.08.2019, as illegal, arbitrary and unconstitutional. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 14.10.2019, which is placed on record, would submit that based on the complaint made by the petitioner, a case in Crime No.578 of 2019 has been registered under Sections 406 and 420 IPC against the named accused and three others and during the course of investigation, L.W.1 was examined and recorded his detailed statement. While this being the situation, the named accused, Srinivas Rao, had a made a complaint with the fourth respondent on 24.05.2019, i.e., three months prior to the petitioner's complaint, stating that the petitioner along with other staff members cheated the company and had taken away the company's property and the said complaint was registered as Crime No.391 of 2019 for the offences under Sections 408 and 420 IPC against the petitioner herein and 13 others and investigation has been taken up. In order to prevent the fourth respondent from investigating into the complaint made by Srinivas Rao, the petitioner chose to make the present complaint against the named accused.

Learned Assistant Government Pleader relying on the written instructions would further submit that without getting into the rival complaints, the fourth respondent would conduct the investigation

independently and undertakes to finalize the same and file appropriate application before the competent Court as expeditiously as possible. In the light of the aforestated detailed written instructions and as the fourth respondent undertakes to take steps in the matter as expeditiously as possible, no further orders are required to be passed in the writ petition.
