HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.13796 OF 2002 ORDER:

When this matter is taken up for hearing, it has been contended by the learned Standing Counsel for the petitionerCorporation that the Labour Court has erroneously passed the award in favour of the 1st respondent-workman by setting aside the order of removal and that the Labour Court should not have set aside the order of removal as the removal order was passed by the disciplinary authority for the proven misconduct in the enquiry and that the petitioner has not committed any illegality in passing the order of removal against the 1st respondentworkman. 2.

This Court having considered the above submissions and the material on record is of the view that the Labour Court has rightly passed the award impugned in favour of the 1st respondent-workman. The petitioners could not point out any illegality or irregularity in the award passed by the Labour Court. There are no merits in this writ petition. 3.

Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
