THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.21891 OF 2019 ORDER:

It is the assertion of the petitioners that they are owners of the property in Sy.No.145 and 155 to an extent of Ac.4-23 gts, situated at Gorrekunta Village, Geesugonda Mandal, Warangal District. While so, one M.Ramaiah, by creating fabricated GPA in respect of Ac.4.23 gts in Sy.No.145, obtained permission of layout from the 2nd respondent and coming to know about the same, the petitioners have filed objections dated 13.05.2019 specifically putting on notice that there are civil disputes pending with regard to the subject property and an individual by name M.Ramaiah has created a fabricated GPA in respect of said property and applied for permission of layout. Inspite of the same, the 2nd respondent approved the layout in favour of the said M.Ramaiah.

Having came to know the about the same, the petitioners once again made a representation on 05.09.2019 bringing it to the notice of the 2nd respondent by enclosing the necessary documents with regard to their specific assertion that the said M.Ramaiah does not have any title over the subject property and thereby granting of layout sanction in favour of the said individual is unauthorized and illegal. Inspite of the same, no action is being taken by the respondents. Hence, the present writ petition.

Learned Standing counsel appearing for the 2nd respondents submits that the objections filed by the petitioners would be considered and necessary orders would be passed.

Having regard to nature of the grievance in the writ petition, without expressing any opinion with regard to the specific contentions raised by the petitioners, this writ petition is disposed of directing the 2nd respondent to consider the objections raised by the petitioners and communicate the decision to the petitioners. It is needless to mention that the respondents shall follow the procedure prescribed and also issue notice to the individual, who is alleged to have prepared and submitted the layout without their being any title over the subject property. The entire exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order. Any delay would result in causing damage to the innocent persons who purchase the subject property, in the layout. Accordingly, this writ petition is disposed of. No order as to costs.

Miscellaneous petitions pending in the writ petition, if any, shall stand closed.
