HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.11215 of 2015 O R D E R :
The petitioner, who is accused in Crime No.336 of 2015 of Amalapuram Town Police Station, East Godavari District, registered for the offences punishable under Sections 354, 354-A, 354-D, 506(2), 507 & 509 I.P.C., filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.
It is alleged in the complaint that the de facto-complainant is working as a Sweeper in the office of BSNL situated at Duddivari Agraharam, Amalapuram. The petitioner, who is working in the same office, has sent a letter to the work place of the husband of the de facto-complainant on 09-04-2015 and he used to send letters on earlier occasions also. The owner under whom the husband of the de facto-complainant works was also surprised to see those letters. In the said letters, serious allegations against the character of the de facto-complainant were made. The petitioner used to insult her by using abusive language and also used to find fault in every work done by her and he used to ask her to fulfil his sexual lust and placed his hand on her chest and also threatened her with dire consequences.
The petitioner threatened to spoil the family of the de facto-complainant, if she does not satisfy his lust. The de factocomplainant informed the insulting behaviour of the petitioner to her husband ten days back and also to one Eswara Rao, who is working in the same office. The de facto-complainant lodged the report against the petitioner on coming to know that one Gnaneswari also lodged a report against the petitioner. Based on the report of the de facto-complainant, the Police registered the present crime for the offences stated supra.
the petitioner-accused, this Court in not inclined to grant anticipatory bail to the petitioner.
