HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42025 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against him in C.C.No.43 of 2016 on the file of the I Metropolitan Magistrate Court (Municipal), Chudi Bazar, Hyderabad.

Heard and perused the material available on record. 3.
The petitioner is as an accused in the above C.C., and he is alleged to have committed the offences under Sections 3(1)(zz)(iii)(xii), 26(2)(i) of the Food Safety & Standards Act, 2006 r/w Regulation 2.3.1 of Food Safety & Standards (Contaminants, Toxins and Residues) Regulation 2011 punishable under Section 59(ii) of Food Safety & Standards Act, 2006. 4.
Considering the facts and circumstances of the case, this Court is not inclined to interfere with the proceedings in the above C.C. 5.
At this stage, the learned Counsel for the petitioner while submitting that NBWs are pending against the petitioner, prayed for recalling the same.

In view of the above submission, the petitioner is directed to surrender before the Court concerned and file an application seeking to recall NBWs issued against him. On such surrender and on such application being filed, the Court concerned is directed to recall NBWs issued against the petitioner on the same day on his executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum to the satisfaction of the Court concerned.
