THE HON'BLE SRI JUSTICE G.CHANDRAIAH C.R.P.NOS.324, 377 AND 397 OF 2015 COMMON ORDER Heard both the counsel.

2. The petitioner in all the three revisions is the plaintiff in the suit in O.S.No.13/2010 on the file of Junior Civil Judge, Bheemunipatnam, filed for permanent injunction of the suit schedule property. The suit is coming up for arguments and at that stage, the plaintiff filed I.A.Nos.519, 520 and 521 of 2014 in O.S.No.13 of 2010 for recalling the plaintiff, by reopening the matter for the purpose of receiving certain documents. By the impugned common order dated 23.12.2014, the court below dismissed the applications and aggrieved by the same the present revisions are filed.

3. The learned counsel appearing for the respondents, while not vehemently opposing the revisions, submitted that the relief sought for by the petitioner may be considered and the court below may be directed to disposed of the suit within certain period.

4. The plaintiff is seeking to mark certain documents on the ground that the same were mixed up with other records and hence he could not file at the time of presentation of the suit and that the said documents are essential for proving his case.

5. Having regard to the facts and circumstances and the submission of the learned counsel for the respondent and in the interest of justice, the impugned order is set aside and the I.As. filed by the plaintiff are allowed and as the suit is of the year 2010, the court below shall dispose of the suit as expeditiously as possible.

6. The revisions are accordingly allowed. No costs.
