HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.2655 of 2017 ORDER:

The petitioner is challenging the notice dated 27-12-2016 issued by the 4th respondent under Section 7 of the Land Encroachment Act in respect of the lands in Sy.No.60 of Chinthakunta Village. The petitioner submitted explanation to the same on 04-01-2017 stating that he is the owner of land to an extent of 3-00 cents in Sy.No.66/AA of Chinthakunta Village, Charla Mandal, Bhadradri Kothagudem District, which is his ancestral property and enjoying the same since more than 30 years and presently standing crop is in existence. The name of the petitioner was also entered in revenue records. Without passing any orders, the respondents are trying to interfere with the above land of the petitioner. Aggrieved by the same, the present writ petition is filed.

Learned counsel for the petitioner submits that though the petitioner is nothing to do with the land in Sy.No.60, but under the guise of notice the respondents are trying to interfere with the other land of the petitioner. Learned Assistant Government Pleader for Revenue submits that since the petitioner has already submitted explanation, it is for the authorities to pass orders in

accordance with law by taking into account the objections of the petitioner.

Now, it is to be seen that as per 1-B register, the petitioner is shown as owner of various extents of land in Sy.Nos 66/AA and 31/AA of Chinthakunta village, Charla Mandal, but the notice was issued on 27-12-2016 for survey No.60 of the same village. The petitioner has already filed explanation to the same stating that he is not concerned with said survey number, it is for the 4th respondent to consider the objections of the petitioner and pass orders. Till passing of final orders, there shall be stay of dispossession of the petitioner from the subject land in this writ petition.

With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 27-01-2017 Note:
