THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.21873 of 2019 ORDER:

The present writ petition is filed questioning the inaction of respondents 1 to 4 in entertaining the complaint of the petitioner, dated 13.08.2019, for providing necessary police protection for enforcement of the judgment and decree, dated 26.10.2018, granted in O.S.No.82 of 2018 by the learned Junior Civil Judge, Miryalaguda, and also sought a direction to the respondents to abide by the order, dated 18.04.2019, passed in E.A.No.18 of 2019 in E.P.No.43 of 2019 in O.S.No.82 of 2018, whereby the learned Junior Civil Judge, directed the Station House Officer, Miryalaguda Rural Police Station, the fourth respondent herein, to provide necessary aid to the petitioners-decree holders for implementation of the decree passed the said suit.

The case of the petitioner is that despite the petitioner obtaining orders from the learned Junior Civil Judge, Miryalaguda, in E.A.No.18 of 2019 in E.P.No.43 of 2019 in O.S.No.82 of 2018, for implementation of the decree, dated 26.10.2018 in O.S.No.82 of 2018, the respondent authorities are not extending such aid to the petitioner to enable him to enforce the judgment and decree of the learned Junior Civil Judge. 3.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, based on the written instructions, dated 16.10.2019, submits that on receiving the complaint from the petitioner, on 13.08.2019, seeking police aid, the fourth respondent went to the land as stated by the petitioner, but the

petitioner was not able to show the boundaries of the suit schedule land. It is stated that, if the petitioner identifies his land and boundaries thereof, the respondent authorities are ready to provide police aid to him. 5.

Having regard to the submissions made on behalf of the fourth respondent, and taking on record the aforestated written instructions, whereby it is stated that the fourth respondent is ready to extend necessary police protection to the petitioner for implementation of the judgment and decree, dated 26.10,.2018, it is left open for the petitioner to make a requisition to the authority concerned and show him the suit schedule land and the boundaries thereof, for enforcement of the decree. 6.

Subject to the above observation, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
