THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9774 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.1 to 4 under Sections 437 and 439 Cr.P.C. seeking to grant bail to them in Crime No.39 of 2016 on the file of Mangalagiri Town Police Station, Guntur District, registered for the offences punishable under Section 8(c ) r/w 20(b)(ii) of the NDPS Act.

Heard and perused the material available on record. It is alleged that the petitioners were found in possession of 895 kgs of ganja.

Learned Counsel for the petitioners submitted that the petitioners did not commit any offence and that the petitioners were arrested on 3.3.2016 and since then, they have been in prison and that charge sheet was filed in the above crime.

Learned Additional Public Prosecutor opposed this petition on the ground that the ganja seized from the possession of the petitioners is the commercial quantity.

In a case of this nature, mere filing of the charge sheet cannot be a ground to grant bail. Considering the facts and circumstances of the case and the quantity of ganja, this Court is not inclined to grant bail to the petitioners at this stage.
