HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 20449 of 2017 Order:

The petitioner is a Sarpanch of Yenamalakuduru Grampanchayat, Penamuluru Mandal, Krishna District. She was elected to the said office in the year 2013. There were some allegations relating to the actions taken by the then Panchayat Secretary during the period from 10.01.2015 to 18.08.2015. An enquiry was conducted by the fourth respondent and the Secretary was kept under suspension. However, when the petitioner received a notice on 23.04.2017 asking the petitioner to submit her explanation and pending passing of final orders granting the cheque power being subject to a counter signature by the Development Officer (Panchayat Raj and Rural Development) of Penamaluru, the present Writ Petition is filed.

Since the impugned notice is only a show cause notice and making arrangement for counter signature by another officer, in view of the allegations for the above period, it is open to the petitioner to submit her explanation to the show cause notice. After considering the explanation, the District Panchayat Officer, Krishna District at Machilipatnam shall pass final orders in accordance with law. In view of the liberty given to the petitioner to submit her explanation to the present show cause notice, this Court is not inclined to interfere with the present arrangement made by the third respondent.

The Writ Petition is, accordingly, disposed of giving liberty to the petitioner to submit her explanation as aforesaid. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
