THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.42899 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner questions the action of the Sub-Registrar, Sharif Nagar, Kurnool District, the 4th respondent, in insisting on production of No Objection Certificate from the Tahsildar, Kurnool Mandal and District, the 3rd respondent, for registration of the subject lands. The petitioner states that the subject lands are private patta lands of their ancestors and are not notified under Section 22-A of the Registration Act.

The issue raised in this Writ Petition is squarely covered by the judgment of this Court in W.P.No.18457 of 2015, dated 24.06.2015. In view of the same, following the aforesaid judgment, this Writ Petition is also disposed of directing the 4th respondent to receive and process the document presented by the petitioner without insisting on production of No Objection Certificate for registration in relation to the subject property. In the event the 4th respondent is of the opinion that the document warrants refusal of registration, he shall pass appropriate orders duly recording the reasons for such refusal in accordance with Section 71 of the Registration Act. If, however, the document is found to be complied with all legal requirements, he shall register and release the same in accordance with due procedure. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition

shall stand closed.
