THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION NO.12012 OF 2016 ORDER:

The Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in Crime No.97 of 2016 of Thipparthy Police Station, Nalgonda District, registered for the offences punishable under Sections 406 and 420 IPC and Section 7 of the Essential Commodities Act.

Heard the learned counsel appearing for the petitioner/accused Nos.2 and 3 and the learned Additional Public Prosecutor, representing the State.

It is represented that for the release of vehicle TATA TCE No.AP-24-TC-2413 together with 35 bags of PDS rice each bag containing 50kgs, the petitioners have already filed petition for interim custody of the seized property and vehicle before the Collector which is numbered as CS1/1386/2016. It is further submitted that even though the petition is pending since 27.06.2016, no orders have been passed thereof.

In that view of the matter, the Criminal Petition is disposed of directing the Collector to dispose of the petition filed by the petitioners for interim custody of the seized property and vehicle within one week from the date of receipt of a copy of this order. Pending miscellaneous applications, if any, shall stand closed in consequence.
