THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.39849 of 2012 ORDER:
This writ petition was filed challenging the action of respondents in proceeding to permit the sand quarrying operations in respect of Muthaipalem Sand Reach, Amaravathi Mandal, Guntur District and not considering the representations of petitioners dated 21.11.2012 and 26.11.2012 respectively. This Court by order dated 27.12.2012 directed the respondents not to grant any lease for removal of sand until the representations of petitioners are considered and the Joint Collector conducts a spot inspection and takes a decision as to the feasibility of granting mining lease by taking into account various facts pleaded by the petitioners.
Thereafter a counter affidavit was filed stating that the Joint Collector, Guntur has inspected the reach on 27.01.2013 and opined that there is no need for reopening of sand reach since no petition was pending with the District. It was also stated that there is no proposal to reopen the sand reach and accordingly, the representations were proposed to be refused.
Consequent to bifurcation of the State, new rules have come into force with regard to auction of sand reach. In view of the above facts, the cause of action in this writ petition does not survive and the writ petition is accordingly dismissed. No order as to costs.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
