Smt.Byreddy Savitri, v. The State Of Andhra Pradesh
THE HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR WRI T PETI TI ON No.18028 OF 2017 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Home for the State of Andhra Pradesh. With their consent, the present writ petition is disposed of at the admission stage itself.
2.
Since this Court is not going into the merits of the case, it may not be necessary to issue notice to the 4th respondent. 3.
The Writ Petition, under Article 226 of the Constitution of India, came to be filed with the following relief: "...to issue a Writ or order more particularly one in the nature of writ of Mandamus or any other appropriate writ declaring the action of the 3rd respondent in insisting the petitioner to settle the issue with the 4th respondent by paying huge amount to him and further threatening the petitioner with dire consequences of implicating her in criminal case in case of her failure to pay amount to the 4th respondent as directed by the 3rd respondent as illegal, arbitrary, unjust and also in violation of settled law of principles and principles of natural justice and consequently direct the 3rd respondent not to insist the petitioner to settle the issue with the 4th respondent by paying huge amount to him."
4.
The grievance of the petitioner is that the 3rd respondent is insisting the petitioner to settle the dispute with the 4th respondent, which is highly illegal and arbitrary. But, the learned Government
CPK,J WP_18028_2017 Pleader, on telephonic instructions, denies such an action by the 3rd respondent.
5.
In that view of the matter, the present Writ Petition is disposed of directing the 3rd respondent not to interfere with the life and personal liberty of the petitioner, except in accordance with law. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. _______________________ JUSTI CE C.
