THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No. 49 of 2015 JUDGMENT: (Per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) Learned counsel for the appellant as well as the learned Government Pleader agreed for setting aside of the judgment and order of the learned Single Judge. Accordingly, we set aside the same. Both the learned counsel agreed to the following order. The 1st respondent shall consider the representations dated 21.01.2013, 19.02.2014 and 07.07.2014 filed by the writ petitioner for refund of the amount in question in accordance with the relevant rules, which were existing at the time of making the representations, and take a decision on the issue without being influenced by the reasoning and the observation of the learned Single Judge. This entire exercise shall be completed within a period of four weeks from the date of communication of this order.
The writ appeal is accordingly allowed.
Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
