HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3572 OF 2017 ORDER:
The case of the petitioners is that they are all landless poor persons and belonged to Schedule Tribe Community and that they occupied the Government land in Survey No.12, situated in Darsi Village and Mandal of Prakasam District about 20 years back and eking out their livelihood by cultivating the said land. Since then they are all in exclusive possession of an extent of Ac.2.00 cents to Ac.3.00 cents each in the aforesaid survey number without interruption by anybody. The 4th respondent mutated their names in revenue records as possessors of the said land and they are also paying land cist to the Government regularly. The petitioners also applied to the 4th respondent to grant assignment pattas in their favour for the aforesaid lands and the same is pending.
The petitioners also installed solar pump sets in the said land after obtaining permission from the concerned authorities and that the Government also released funds to dig the bore wells in the aforesaid lands. While so, the 4th respondent without following due process of law is trying to dispossess the petitioners from the subject land. Aggrieved by the same present writ petition is filed. Heard learned counsel for the petitioners.
Learned Assistant Government Pleader for Revenue submits that the respondent authorities will follow due process of law before taking any action against the petitioners.
Recording the aforesaid submission of the learned Assistant Government Pleader, the writ petition is disposed directing the respondents not to dispossess the petitioners without following due process of law. No order as to costs.
As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
