HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 7540 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the refusal of the respondent bank to extend the rightful entitlements and monetary benefits to the petitioner, as illegal and arbitrary.

The record discloses that the petitioner was working with the respondent bank and he applied for voluntary retirement under voluntary retirement scheme 2000 introduced by the respondent bank and the same was accepted by the respondent bank vide orders dated 09.03.2001. The grievance of the petitioner is that though he retired under the voluntary retirement scheme, the respondents are not disbursing the retiral benefits payable to him. Having gone through the entire record and in the facts and circumstances of the case, this Court is of the view that the writ petition can be disposed of directing the petitioner to submit a representation to the respondents.

Accordingly, the writ petition is disposed of directing the petitioner to submit a representation to the respondents within two weeks from the date of receipt of a copy of this order, and upon receiving such representation, the respondents shall consider and pass appropriate orders thereon within four weeks thereafter.
