HONOURABLE SRI JUSTICE A. RAJASHEKAR REDDY WRIT PETITION No. 18715 OF 2018.
O R D E R :
This writ petition is filed seeking mandamus to declare the action of the first respondent in interfering in the civil dispute in respect of the suit schedule property in O.S.No. 35 of 2018 on the file of the Court of Principal Senior Civil Judge, Nandigama, as arbitrary, illegal and violative of Article 21 of the Constitution of India and consequently to direct the respondent No.1 not to interfere in the civil dispute in respect of the land admeasuring Acs:4-92 cents in R.S.No. 58/2 of Seri Amaravaram village, Kanchikacherla Mandal, Krishna district, without following due process of law.
2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents.
3. The learned Assistant Government Pleader for Home submitted written instructions filed by the Sub-Inspector of Police, Kanchikacherla Police Station, Krishna district stating that on the complaint of the fourth respondent, Petty Case No.88 of 2018 was registered for an offence under section 290 of I.P.C., against the petitioner and his father and the same ended in conviction on 08/2/2018 and a fine of Rs.200/- each was imposed in STC.No.88 of 2018 and a further complaint of the fourth respondent was registered on 30/5/2018 and during the course of enquiry it was revealed that the land is under dispute in O.S.No. 35 of 2018 against the respondent No.4. As such, the first respondent had suggested for redressal and it is also stated that the first respondent never interfered with the civil dispute as alleged by the petitioner. The allegation that the petitioner was asked to vacate the said land in favour of the fourth respondent is also disputed.
4. Recording the same, the writ petition is disposed of at the admission stage.
5. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand disposed of. No costs. _____________________________ JUSTICE A. RAJASHEKAR REDDY.
