ORDER
This revision is filed challenging the order dated 02.07.2019 passed in Crl.M.P.No.40 of 2019 in Cr.No.87 of 2019 by the Additional Judicial First Class Magistrate, Ramannapet, Nalgonda District, dismissing the petition filed under Section 457 Cr.P.C. by the petitioner/accused/owner of the property seeking interim custody of case property seized by the police on the complaint made by the Sub-Inspector of Police that the petitioner was manufacturing duplicate poultry feed and selling the same to public with huge amount, thereby cheated the Government.

Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor for the respondent-State and perused the material on record.

Learned counsel for the petitioner submits that the petitioner is owner of the case property and is doing business by eking out his livelihood and that if the property kept idle, damage would be caused and he will suffer irreparable loss. He further submits that the petitioner fill furnish suitable security for return of the properties. 4.
Learned Additional Public Prosecutor opposed the relief prayed by the petitioner.

Having regard to the facts and circumstances and the property if kept idle being damaged resulting loss to the petitioner, it would be appropriate to direct the trial Court to release the case property to the petitioner on his furnishing Bank guarantee for a sum of Rs.50,000/- (Rupees fifty thousand only) to its satisfaction and an undertaking by way of affidavit that he shall not sell the poultry feed to the public till disposal of the case and he shall produce the case property before the Court as and when required during trial. 6.
With the above direction, the Criminal Revision Case is disposed of.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
