THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42143 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to declare the action of respondent Nos.2 and 3 in not completing the investigation in Crime No.244 of 2016 on the file of Hussainialam Police Station, Hyderabad and filing charge sheet as illegal and arbitrary. 2.

Case of the petitioner is that she filed a private complaint against one Mukhtar Ahmed Khan and Iftekhar Ahmed Khan before the Chief Metropolitan Magistrate, Nampally, Hyderabad and the same was referred to the police for investigation; that respondent No.3 registered the same as the aforementioned case for the offences punishable under Sections 323, 354, 427, 447, 506, 509 and 120-B read with 34 I.P.C. and Section 25 of the Arms Act, 1959, but respondent Nos.2 and 3 are not completing the investigation in the said crime and filing charge sheet. 3.

Heard and perused the material available on record. 4.

The F.I.R. was registered on 9.11.2016. Hence, this Court is of the view that the writ petition is premature in nature and hence, it is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
