HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.7603 OF 2002 ORDER:

This writ petition is filed seeking to issue a writ of Certiorari calling for the records relating to and connected with M.W. Case No.376/2000 on the file of the 1st respondent and to quash the order passed therein on 17.1.2002 by holding it as arbitrary and illegal.

Heard Sri B. Sudhakhar Reddy, learned Counsel for the petitioner and the learned Government Pleader for Labour. 3.

The case of the petitioner is that he is doing business in supply of fish boxes to the fishermen in order to preserve the fish. While his nephew was taking care of his shop, the 2nd respondent visited his shop and found that one B. Srinivas, who is the nephew of the petitioner, was engaged in the premises and he was not being paid minimum rate of wages. Then, the 2nd respondent filed an application before the 1st respondent under Section 20 of the Minimum Wages Act for non-payment of minimum rate of wages fixed by the Government to the said B. Srinivas. The 1st respondent passed the order impugned on 17.1.2002 directing the petitioner herein to deposit Rs.2,030/- towards difference of

minimum wages by way of bank draft drawn in favour of the 1st respondent. Challenging the same, the present writ petition is filed. 4.

Having considered the submissions made by the parties, this Court is of the view that an amount of Rs.2,030/- was directed to be paid to the so called B. Srinivas, who is none other than the nephew of the petitioner and who has been working in the shop of the petitioner, and therefore, payment of such wages would not cause any prejudice to the petitioner. There are no merits in this writ petition.

Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
