This writ petition is filed challenging the endorsement order dated 15-11-2016 issued by the 2nd respondent canceling the approved plan for construction of the building at D.No.27-1-225 and 225/1 in Ward No.61 in Sy.No.117 in Srinagar, Chinagantyada within the limits of Greater Visakhapatnam Municipal Corporation. Learned counsel for the petitioners submits that without issuing notice and without giving opportunity of hearing, impugned order has been passed, which is in violation of principles of natural justice. He also stated that the petitioners produced relevant documents and basing on the same only, approval was granted. Sri S.Laxmi Narayana Reddy, learned Standing Counsel for the respondent-Corporation submits that due procedure will be followed after issuing notice to the petitioner.
A reading of impugned order also goes to show that no notice was issued to the petitioner. Only on the ground of violation of principles of natural justice, the impugned order is liable to be set aside.
In view of the same, the impugned order is set aside. However, it is open for the respondent-authorities to take action in accordance with law.
Accordingly, the writ petition is allowed to the extent indicated above. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
