The Hon'ble Sri Justice C.V.Nagarjuna Reddy Writ Petition No.34602 of 2012 Dated 29.07.2015 Between:

N.Bangaraju ... Petitioner and Registrar of Co-operative Societies/ District Co-operative Officer Visakhapatnam and 6 others

...Respondents

Counsel for the petitioner: Mr.P.Rajasekhar Counsel for respondent No.1: AGP for Co-operation Counsel for respondent Nos.3 & 4: Mr.Sitaram Chaparla Counsel for respondent No.6: Mr.P.Badri Premnath Counsel for respondent No.7: Smt.N(P) Anjana Devi Counsel for respondent Nos.2 & 5: None appeared The Court made the following:

Order:

This Writ Petition is filed for a Mandamus to declare the inaction of respondent No.1, in taking action against respondent Nos.3, 4 and 5, as illegal

and arbitrary.

The petitioner sought for a consequential direction to respondent No.1 to order freezing of respondent No.2's accounts lying with respondent Nos.6 and 7 till the disputes between respondent Nos.3, 4 and 5 are resolved by the appropriate Authority/Tribunal.

Mr.P.Rajsekhar, learned Counsel for the petitioner, after perusal of separate Orders, dated 10-04-2015, in IA.No.60 of 2012 in OP.No.127 of 2012 and IA.No.58 of 2012 in OP.No.126 of 2012, of the Chairman, Andhra Pradesh Co-operative Tribunal, Visakhapatnam, has fairly conceded that the said IAs filed by respondent No.2 and respondent Nos.3 and 4 respectively for rejection of the OPs were allowed, as a result of which, both the OPs have been dismissed.

As rightly pointed out by the learned Counsel for respondent Nos.3 and 4, with the dismissal of the OPs filed by respondent No.5, the whole substratum, on which the petitioner has made representations to respondent No.1, has disappeared.

In the light of the above undisputed facts, the Writ Petition must fail and the same is, accordingly,

dismissed.

As a sequel to dismissal of the Writ Petition, WPMP.No.43979 of 2012, filed by the petitioner for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 29th July, 2015 LUR
