HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE WRIT PETITION No. 17074 of 2010 ORDER:

Heard learned counsel for the petitioner.

The petitioner, in the instant writ petition, seeks the following relief:

"For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus, declaring the action of the first respondent in passing the impugned order, dated 12.07.2010, in proceedings No.G4/590/2010, is illegal, arbitrary and violative of principles of natural justice and set aside the same and consequently direct the respondents to supply the essential commodities as per the ration cards attached to the petitioner's F.P.Shop No.4597, Lakshmipur, Ramagundam, Karimnagar District and pass such other order or orders may deem fit and proper in the circumstances of the case."

I have perused the order, dated 12.07.2010 (Annexure P-2). By this order, the appellate authority vacated the order of stay granted by order, dated 01.07.2010 (Annexure P-3). Though this writ petition was filed in 2010, it was not placed before the Court till July, 2015.

The petitioner never bothered to take it before the Court and seek any interim order. As a result thereof, the order vacating the order of stay operates till today.

In view thereof, I find no reason to interfere with such order and I am satisfied that the following order shall meet the ends of justice: "If the appeal filed by the petitioner bearing No. G4/590/2010, in which the orders, dated 01.07.2010 and 12.07.2010, were passed, is pending, the same may be decided on merits in accordance with law, as expeditiously as possible and preferably within a period of three months from the date of this order."

With these observations, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, also stand disposed of. There shall be no order as to costs. _________________________ DILIP B. BHOSALE, ACJ Dt:14.08.2015 kdl
