ORDER

This Writ Petition is filed seeking the following relief: "to issue a Writ, Order or Direction particularly a Writ of Mandamus directing the respondents to absorb the petitioner as Junior Assistant in the existing vacancy in which she is working on consolidated pay basis within a specified time and also direct the respondents to pay her salary for the period she had already worked and also to continue to pay the salary to the petitioner and pass such other order or orders as are deemed fit and proper in the circumstances of the case."

Heard learned counsel on either side.

It is the case of the petitioner that she was appointed as Junior Assistant in the 5th respondent-Temple on 22.12.2011 and she has been discharging her duties to the best satisfaction of her superiors. Thereafter, she submitted representations dated 1.9.2012 and 8.9.2012 to the respondents seeking to regularize her services. But, so far, no orders have been passed thereon.

Learned counsel appearing for the petitioner submits that the respondents be directed to consider the said representations dated 1.9.2012 and 8.9.2012 and pass appropriate orders thereon.

Learned Government Pleader as well as learned Standing Counsel appearing for the respondents contended that the petitioner was never appointed in the 5th respondenttemple and as such, the question of her working as Junior Assistant in 5th respondent-temple does not arise. Learned counsel appearing for the petitioner does not dispute the same.

In view of the fact that the petitioner has not worked as Junior Assistant in the 5th respondent-Temple, this Court cannot direct the respondents to regularize her services. There are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. No costs. Miscellaneous petitions, pending, if any shall stand closed.
