THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.19173 of 2003 ORDER:

This writ petition is filed seeking the following relief: "to issue a Writ of Mandamaus of direction declaring (i) the action of the respondents in denying the payment of 50% more compensation on par with the 2nd batch of employees who retired under Circular No 81/2001, dt. 5-12-01 as illegal, arbitrary, discriminatory and violative of Art.14 of the Constitution of India (ii) Clause 4.3 of Circular No 81/2001, dt. 5-12-01 is also applicable to the petitioners who retired under Circular No 71/2000, dt.4-12-2000 and circular No 80/2000, dt 26-12-2000, as the Wage Revision due as on dt.1-1-97 has not been effected by the respondents, the petitioners are legally entitled for payment 50% more compensation on par with the 2nd batch of employees who retired under Circular No 81/2001, dt. 05-12-2001." 2.

Heard Sri A.Srinivasa Sarma, learned counsel for the petitioners and Sri D.Ravishankar Rao, learned Standing Counsel for the respondents.

Learned counsel for the petitioners as well as learned Standing Counsel had fairly conceded that the relief sought for in the writ petition cannot be granted in view of the Judgment, dated 22.05.2003 passed by the Hon'ble Supreme Court in the case of Vice Chairman and Managing Director, A.P. SIDC Ltd., v R.Varaprasad1.

In view of the above submission, the Writ Petition is dismissed.

Miscellaneous petitions pending if any, shall stand closed. No costs.
